DOT Physicals:

Since 2004, Bruen Medical Partners has proudly offered the Department of Transportation (DOT) physicals to anyone requiring a Commercial Driver's License (CDL). Our professional certified Phlebotomist's team can perform the federally-mandated procedures to keep you or your employees safe driving on the road. We know the federal regulations and we understand the importance of adhering to them. Let us partner with you to promote health and safety in the workplace and out on the road.

If you are a bus or trucking company, your staff must be up to date on their DOT requirements. This is not just to keep your company free of fines, but also to ensure your employees are fit for duty. The last thing a business or school can afford is a medically unfit individual operating a commercial vehicle. Our services allow you to hire and maintain safe and healthy drivers while upholding your good reputation.

Are you applying for a job that requires the operation of a commercial vehicle? Many companies require a CDL before you can be a candidate for hire, and obtaining that requires a DOT physical. Let us ensure your resume doesn't go overlooked and your potential employer knows you're serious about the job.

DOT-Compliant Solutions for Employers

Remaining DOT-compliant is important for any business that requires its employees to have commercial driver's licenses (CDLs). DOT regulations, required by FMCSA, mandate that individuals carrying a CDL must submit to regular drug and alcohol testing, including urine and breathalyzer tests in order to ensure their own safety and the safety of those around them.

We offer a complete range of certified DOT testing services. Our labs adhere to the strict standards set forth by FMCSA in regards to DOT testing and our staff is thoroughly trained in proper testing procedures and techniques. Our collectors are Breath Alcohol Technician (BAT) certified, as well as Certified Lifeloc Operator and Calibration Technicians (C-LOCT). Whether you need random DOT drug testing, a post-accident breathalyzer test, or return-to-duty testing, you can rely on our friendly and professional team.

DOT Testing Services We Provide

FMCSA regulations require regular drug and alcohol testing for businesses that employ CDL-holding drivers. This includes for-hire motor carriers, private motor carriers, governments (Federal, State, and local), civic organizations, churches, and anyone who owns, leases, or assigns drivers to operate commercial vehicles. This includes workers that fall under the FAA, FRA, FMSCA, PHMSA, FTA, and USCG. In all cases, employers are responsible for conducting the required DOT testing and ensuring DOT compliance of their employees. At Bruen Medical Partners, we can help you adhere to these strict regulations.

We provide DOT testing services for a variety of circumstances, including:

Post-accident testing
Testing with reasonable suspicion
Random drug/alcohol testing
Return-to-duty testing
Follow-up testing after reinstatement

We offer both urine testing and breath testing in our clean, state-of-the-art facilities. With every DOT test we carry out, we strive to ensure complete comfort and confidentiality. Our certified collectors use advanced equipment, including the federally-approved Lifeloc Phoenix® 6.0 Portable Breath Alcohol Testing Equipment. We can even come to you with our mobile DOT testing services designed for your convenience. As with all our testing services, we work to provide the fastest, most accurate results at the most affordable rates currently available.

What We Test For:

FMCSA requires urine drug testing for DOT compliance, as well as either breath alcohol testing or saliva testing to check for alcohol use. At BMP, we are trained and experienced in all of these methods and can help you select the right solution for your business or employees.

In addition to our DOT alcohol testing services, our DOT testing detects the following drugs:

Marijuana (THC metabolite)
Phencyclidine (PCP)
Opiates (including heroin)

We can help you with your unique DOT testing needs. In fact, we provide more than just DOT-compliant drug and alcohol testing services; we can also assist you with everything from random name generation to audit preparation to DOT protocol training and more.

Urine Instant Point of Care Drug Test

There are a number of different factors that influence the cost of the BMP Drug Test, these include:

· Whether you book an appointment at our Drug Testing Clinic or opt for the mobile collection service

· The number of drugs you wish to be tested for

· The number of drug test donors that you wish to be tested in one booking

The cost of one individual booking urine BMP Drug Test is from $68.00.

Depending on the factors listed above, the cost of commercial testing for a number of employees can be as little as $50.00 per person.

If required, non-negative drug test samples can be sent securely for laboratory screening and confirmation testing for an additional $40.00 per person.

Optional alcohol testing can be performed in conjunction with BMP Drug Test.

Has your New York employer or prospective employer asked you to take a drug test? Federal law places few limits on employer drug testing: Although the federal government requires testing by employers in a few safety-sensitive industries (including transportation, aviation, and contractors with NASA and the Department of Defense), federal law doesn’t otherwise require – or prohibit drug tests. For the most part, state and local laws determine whether an employer may test employees and applicants for drugs.

No New York Drug Testing Laws

Although many states have passed laws regulating or restricting an employer’s right to require drug testing, New York is not one of them. The state of New York has no law addressing drug testing in private employment. This means that drug testing is not prohibited or restricted, unless it violates other legal provisions (such as a law prohibiting discrimination; see below).

Legal Claims for Drug Testing

Because New York state law doesn’t put any limits on workplace drug testing, employees who believe their test was illegal will have to rely on other legal theories. For example, an employer may run into legal trouble based on who is tested or how the test is conducted.

Here are some examples:

Disability discrimination.

The Americans with Disabilities Act (ACA) protects an applicant or employee who is taking medication for a disability. Some prescribed medications can result in a positive result on a drug test, and some drugs that would otherwise be illegal (such as opiates) are legitimately prescribed for certain conditions. If an applicant is turned down because of a positive drug test, and the applicant's medication was legally prescribed for a disability, the company could be liable (unless the drug is medical marijuana).

  • Other discrimination claims. An employer who singles out certain groups of employees – for example, by race, age, or gender– for drug testing could face a discrimination claim.

  • Invasion of privacy.

Even an employer that has a legitimate reason to test might violate employee privacy in the way it conducts the test. For example, requiring employees to disrobe or provide a urine sample in front of others could be a privacy violation, depending on the circumstances.

  • Defamation.

An employee might have a valid claim for defamation if the employer publicizes a false positive result, if the employer acts in bad faith and knew (or should have known) that the result was incorrect.

The New York Drug Law For Marijuana Possession.

The Vast Majority Of Drug Test Failures in New York Are For Breaking New York  Drug Laws For Marijuana, Not Federal Or Local Laws.

[Federal And New York Drug Test Laws On Marijuana.]

New York Drug Laws On Marijuana.

New York drug laws have their own specific strengths you must avoid and weakness in which one can take advantage when it comes to marijuana. The same is true of the Federal Laws concerning marijuana.

Marijuana is the third most popular recreational drug in New York behind only alcohol and tobacco.  Marijuana has been used by nearly 100 million Americans at one time or another with an equal cross-section of people in New York using marijuana.  According to the federal government, some 25 million Americans have smoked marijuana in the past year and more than 14 million do so regularly despite harsh laws against its use.  New York is no exception in its implementation of marijuana law.

Unlike alcohol, for which impairment can be reasonably measured using a breathalyzer, valid detection for marijuana requires drug testing.   This is time-consuming, complicated and the drug tests for marijuana cannot determine an approximate degree of impairment.   The detection of marijuana is also complicated by the various types of drug testing available and the types of myths, half-truths and rumors that surround marijuana drug testing.
